1) How do I use Florida Incorporation Online? [ top ]

Whether you are looking to form a Limited Liability Company, a Company for Profit, a Not-For-Profit Company, a Professional Company or simply registering a Fictitious Name, we provide a simple online process to have your entity created by a legal professional. Florida Incorporation Online enables you to provide us with the information and payments needed to incorporate your company. If you are unsure as to the type of entity you would like to create, we invite you utilize one or our consultation processes to get an opinion on the matter. However, if you are at the stage that you would like to immediately take steps to incorporate your business you must:

  1. Select your choice of entity
  2. Fill out the online form in its entirety, and
  3. Click on the Paypal button and submit the requisite payment
  4. The firm will contact you if additional information is needed

2) Can I have the firm Incorporate my Business without using the online process? [ top ]

Yes. If you do not wish to utilize Florida Incorporation Online to create your business entity you can contact the firm to complete the process via email, telephone, regular mail or in person.

3) How long does the Incorporation Process take? [ top ]

The regular processing time for incorporation is usually between 7-10 days; however, we do offer expedited services. For an additional $50 your incorporation can be completed in approximately 3-5 days. For an additional $100 we will have your incorporation completed in approximately 1-2 days. Please note that processing time is partly dependent on the Florida Department of State.

  • Regular Service: The regular processing time for a incorporation is usually between 7-10 days. The Incorporation Package includes: 1) the preparation and filing of the documents relative to the incorporation package you selected, 2) State Filing Fees and 3) Attorney Fees. Orders received after 3:00 pm will be processed the following business day.

  • 3-5 Day Service: If you need to incorporate fast, for an additional $50 we offer a 3-5 business day incorporation service. We will expedite the incorporation process and the Incorporation Package will be ready in approximately 3-5 business days, after receipt of payment.

  • 1-2 Day Service: If you need your business formed urgently, for an additional $100.00 we offer a 1-2 business day incorporation service. We will expedite the incorporation process and the Incorporation Package will be ready in approximately 1-2 business days, after receipt of payment.

  • Department of State Processing: We offer the previously described levels of rush service. When you request one of our rush services, we promptly deliver your documentation to the Department of State for processing; however, occasionally, for reasons outside our control, the State processing may be delayed. In the event this happens you may be temporarily delayed in receiving your Corporate Package.

4) How do I use Florida Eviction Online? [ top ]

Florida Eviction Online enables landlords to start the eviction process online.  If you are unsure if you have the legal right to evict a tenant, we invite you to utilize one of our consultation processes to get an opinion on the matter. However, if you are at the stage that you would like to immediately take steps to have your tenant removed through the eviction process you must:

  1. Select eviction for possession only or eviction for possession and damages

  2. Fill out the relative eviction form in its entirety
  3. Click on the PayPal button and submit the requisite payment.
  4. The firm will contact you to obtain all necessary documents to complete the eviction

5) Can I have the firm evict my tenant without using the online process? [ top ]

Yes. If do not wish to utilize Florida Evictions Online to evict your tenant you can contact the firm to complete the process via email, telephone, regular mail or in person.

6) How long does the eviction process take? [ top ]

Generally, if you are only seeking to recover possession of your property and the tenant does not respond to our complaint, the process is usually completed in a little under a month. However, if you are seeking to recover past due rent as a hybrid lawsuit, or if your tenant responds to our complaint for eviction, the process is usually completed in less than two months. This is because an eviction to recover past due rent needs to be served on the tenant personally but an eviction solely for possession can be posted. As such, a suit for damages could involve our process server spending extra time trying to sever the tenant rather than just posting it on the property. Also, a response by your tenant would require extra time because hearings may be necessary to resolve the suit.

7) What if I have more than one tenant on the lease? [ top ]

Our eviction process packages include the regular service of process of up to two defendant tenants. An additional $40 fee will be required for each additional defendant tenant over two. The additional fee is to cover the fee required by the process server.

8) What is Divorce Express? [ top ]

Divorce express is an online process wherein a customer can promptly obtain quality legal services for their divorce. If your divorce is uncontested, you can submit information and have the firm provide legal services on you behalf. However, if your divorce is contested you will not be able to use Divorce Express, but you will be able to hire for the firm for representation.

9) How do I use Divorce Express? [ top ]

If you have a contested divorce, simply utilize one of our consultation processes to get a brief evaluation of your case and decide if you would like to hire the firm. On the other hand, if you and your spouse have already agreed to terms, simply select whether you would like us to: prepare and provide you with Simplified Divorce Documents; prepare and provide you with Uncontested Divorce Documents; or provide you with Complete Representation for your Uncontested Divorce. Please note that everyone does not automatically qualify for a Simplified Divorce, so if you are unsure which one suits your circumstances and desires, we invite you to utilize one of our online processes to obtain additional information on the matter, however if you are at the stage that you would like to immediately start the divorce process, simply:

  1. Select your desired service
  2. Fill out the relative form in its entirety
  3. Click on the Paypal button to submit payment
  4. The firm will contact you if additional information is needed

10) Can you handle my divorce without using the online process? [ top ]

Yes. If you do not wish to use Florida Divorce Express to facilitate your divorce, you can contact the firm to complete the process via email, telephone, regular mail or in person.

11) How long does the Divorce Process take? [ top ]

The length of the divorce process depend various things, but the main variable is whether you and your spouse are in agreement with the divorce terms. If the couple can enter into a settlement agreement, the process can be completed in as short as a month. On the other hand, if the couple cannot agree on the divorce terms the suit can take several months to complete.

The way we have structured Divorce Express, you are able to dictate the pace of your divorce. Both the Simplified Divorce and the Uncontested Divorce without representation provide you with the documents necessary to file and complete your divorce with the courts. Once you have received the information, the pace is determined by how fast you execute the documents file them with the court and schedule your hearing. As for the Uncontested Divorce with representation, we try to promptly obtain all of the necessary information from you, prepare the documents to be filed with the court and obtain an expedited hearing date.

12) What is a Consultation? [ top ]

A consultation is a time where a legal professional reviews information submitted by you to make an evaluation as to the merits of your case. The legal professional will provide their legal opinion as to your case that may be different from another attorney’s assessment. Please note that the opinion provided to you from the examination of your submitted information is limited to the scope of the information you submitted and is unique as to your circumstances. Please be advised that your use of this firm to obtain a consultation does not mean that this firm has agreed to represent you, or that an attorney client relationship has been formed.


13) How Do I use the Online Consultation? [ top ]

To utilize one of the online consultations, simply complete the following steps

  2. Enter your legal issue as concise as possible
  3. Click on the paypal button and make the requisite payment.
  4. The firm may contact you for additional information if consultation time permits

14) How does the Online Consultation work? [ top ]

After the firm receives your online payment for the consultation, your submitted information will be reviewed and you will receive a short letter from an attorney regarding your legal issue. Please note the time restraints on the Consultations. If you desire an online consultation and think that your case cannot be evaluated in less than 60 minutes, contact us and we may be able to perform a custom consultation for your unique legal issue.

15) What does the Online Consultation include? [ top ]

Your information will be reviewed and a responding opinion letter will be generated based on the information received. Please note, that depending on the information received we may request additional information or documentation for review. Please be advised that the consultation charges are based on the consulting attorney’s time and the time indicated will not be exceeded. Simple Consultation includes 10 minutes of evaluation and 5 minutes response time. Standard Consultation includes 20 minutes of evaluation and 10 minutes of response time. Advanced Consultation includes 45 minutes of evaluation and 15 minutes of response time. The opinion letter will also include a quote.

16) Can I obtain an in-person or phone consultation? [ top ]

Yes. If you are uncomfortable with the online consultation process, or feel that you need more time that is allotted for those services, you can contact the Firm to schedule an in-person or phone consultation. Please note that payment must be made in advance at the time of scheduling.

17) How do I hire the firm for representation? [ top ]

If you are utilizing of the online services, submit the requisite information and payment to the firm. The firm will then contact you so that all relative written representation agreements can be executed. If you are not utilizing the online services, you may contact the firm for representation.

18) Is there an alternative to the online service? [ top ]

Yes. If you do not feel comfortable with the online services, you may submit the requisite information via mail or facsimile; however, please be advised that the information will not be reviewed until payment is received. The online payment method is implemented for your convenience but not as your only option.

19) What are In-house legal services? [ top ]

In-house legal services are services performed by Daniel & DiPace P.L. In-House Legal Services performed on behalf of customer is governed by a written agreement between the customer and Daniel & DiPace P.L.

20) What are networked legal services? [ top ]

Networked Legal Services are services provided by attorneys or firms that are closely networked with the firm. Networked Legal Services performed on behalf of a customer is governed by a written agreement between the customer, Daniel & DiPace P.L and the customer’s assigned network attorney.

21) Will my services be performed by a law firm? [ top ]

Yes. Florida Legal Online is the online presence of the Law Offices of Daniel & DiPace P.L. All requested services will be performed by our law office, or if need be, one of our networked attorneys.

22) How do the online payments work? [ top ]

This website allows individuals or entities to: 1) pay an invoice, 2) submit a retainer for a new case, 3) pay for a consultation or 4) pay for online legal services as described above. Please be advised that all website payments are made via PayPal, an independent internet service that accepts most major credit cards. Please feel free to visit PayPal.com for their terms and conditions of use. Again, a lawyer/client relationship occurs only when, and not until, the firm enters into a written agreement with you for the performance of legal services and your initial retainer funds has cleared our account.

23) Is there anything else I should know? [ top ]
